網拍LV贗品 法國法院判eBay賠台幣逾十九億

巴黎法院今天裁定,網路拍賣商eBay因為在線上販售仿冒奢華品,必須支付四千萬歐元
(台幣約十九億一千多萬元)損害賠償給路易威登(LV)集團。

商業法庭的裁定支持酩悅軒尼詩路易威登集團(LVMH)的六種品牌;該集團一年半前開
始興訟,指控eBay網拍仿冒的手提包、衣物與其他奢華品,同時也非法銷售香水。

法院裁定全球最大線上拍賣商eBay必須支付一千九百二十八萬歐元給LVMH集團,並支
付一千七百三十萬歐元給該集團姊妹企業克莉絲汀迪奧女裝公司,賠償它們的品牌形象損
失以及因此引發的精神傷害。

eBay也須支付三百二十五萬歐元給四款香水品牌,包括克莉絲汀迪奧、高田賢三、紀梵
希以及嬌蘭,因為eBay銷售香水侵害公司授權網。

法院禁止eBay在網站上針對化妝品與香水品牌廣告。eBay則表示將針對判決提出上
訴。

LVMH集團主張,eBay並未採取足夠行動,防止網站上拍賣該集團產品的仿冒品,同時
也未獲合法授權販售該集團的真品。

eBay號稱在全球三十九個市場擁有約八千四百萬名有效使用者,它目前正面臨一連串訴
訟。

被告侵權 eBay判賠償LV集團四千萬歐元

著名的競標網站eBay在法國又踢到鐵板。這個拍賣網站今天被巴黎商業法庭以非法侵害
路易威登(LV)集團旗下多個品牌的利益,判決須支付近四千萬歐元的賠償金給有六個
品牌的路易威登集團。

這一判決可能迫使eBay改變技術體系結構及經營模式。 路易威登集團控告法國版eBay
在二零零六年網拍四十萬個LV的假皮包,路易威登集團認為,eBay知道網民拍賣假冒的
皮包、口紅和香水,卻沒有禁止,即使網民拍賣的產品不是仿冒品,這種銷售方式也違反
路易威登集團的銷售原則,eBay也沒有阻止此非法銷售行為。

路易威登集團控告eBay拍賣的二手產品還包括集團旗下的迪奧、高田賢三、紀梵希和嬌
蘭品牌的香水,因此eBay也要支付三百二十五萬歐元給四大香水品牌,法院下令禁止
eBay再登出這些品牌的香水和化妝品銷售廣告,每拖延一天將罰款五萬歐元。

在此之前,eBay網站以法律為護身符,成功避免了販售偽造商品的裁定,例如在二零零
四年六月,自認只是一個技術供應商,無法對其用戶的行動負責。

eBay並說,為了打擊仿冒品,他們設立Vero認證機制,只要精品公司在eBay上發現疑
似贗品的網拍物,可通知eBay,他們承諾立刻下架。

但路易威登集團及愛馬仕等公司主張,這個機制不能有效遏止仿冒品歪風。因此,六月四
日在特洛依有關愛馬仕商品的判決,以及今天在巴黎的判決,預料將會在世界各地引發連
鎖官司效應,並對eBay經營和技術模式構成挑戰。

二零零六年愛馬仕發現法國版eBay允許網友在網站出售兩個該品牌的仿冒手提包和飾
品。愛馬仕認為,eBay提供了一個提升仿冒手提包價值的方式。

特洛依市法庭在六月四日首度就拍賣網站販售仿冒品官司做出判決,法官認為eBay未能
有效監督並制止這類不法行為,因而觸犯仿冒罪,必須與提出拍賣物的網民共同賠償愛馬
仕。

另外,法國版eBay還必須在首頁刊登三個月的法院判決。eBay對這兩個判決都表示將提出上訴。

eBay to pay $63 million as damages to LV

PARIS: A court here has ordered Internet auctioneer eBay to pay 63
million dollars as damages to Louis Vuitton for selling fake luxury goods
online.

The auctioneer has also been barred from selling four perfume brands-
Christian Dior, Kenzo, Givenchy and Guerlain- in the ruling intended to
send a strong message about copyright protection.

eBay, the world's largest online auctioneer, immediately announced that it
was lodging an appeal and rejected the view that the court decision was a
victory for copyright law.

“This decision is not based on combating counterfeit material. It is based
on LVMH's desire to protect its commercial practices and exclude
competition,” said a spokeswoman for eBay in Paris.

“This is being done at the expense of the consumers and sellers to whom
eBay is always offering opportunities,” she added.

eBay was ordered to pay 30.36 million dollars to LVMH and 27.24 million
dollars to its sister company Christian Dior Couture for damage to their
brand images and causing moral harm. It has also been directed to pay
5.11 million dollars to the four perfume brands for sales in violation of its
authorised network.

LVMH, meanwhile, hailed the decision as a major coup against illegal sales
on the Internet. “It is a major first, because of the principals that it
recognises and the amount sought,” said Pierre Gode, an aide to LVMH
president Bernard Arnault.

Describing eBay's anti-counterfeit measures as “empty”, Gode said the
court decision was “important for the creative industry” and that it
“protected brands by considering them an important part of French
heritage”.
